Florida law pertaining to divorce and family law matters is set forth in Chapter 61, Florida Statutes.
While the legal issues pertaining to family law are organized in this part of the Florida Statutes, the interpretation and application of the laws are far from simple. Each family law case and issue should be evaluated on the unique facts and circumstances.
Certainly, there is no “one size – fits all” approach that applies to a family law case or the proper legal representation of a family law matter.
Amicable vs. A Battle
As noted in Section 61.001, Purpose of Chapter – Dissolution of Marriage; Support; and Time-Sharing, the purposes of the chapter are to “promote the amicable settlement of disputes that arise between parties to a marriage; and to mitigate the potential harm to the spouses and their children caused by the process of legal dissolution of marriage.”
While these purposes are noble in a sense, one or both parties to a family law matter often take or resort to the low road of immaturity, selfishness, and stubbornness when dealing with a family law issue or matter.
