Battery and Felony Battery
Battery occurs when a person intentionally touches or strikes another person against their will and intentionally causes harm to that person. Battery is a first degree misdemeanor and is punishable with up to 1 year of imprisonment and a $1,000.00 fine.
Felony battery occurs when a person with a previous conviction for battery commits any second or subsequent battery. Felony battery in this instance is a third degree felony punishable with up to 5 years of imprisonment and a $5,000.00 fine.
