Florida, is a no-fault state, meaning under-Florida law, divorce is granted without grounds for “cause” or finding “fault”, as long as the marriage is “irretrievably broken". Consequently, most uncontested divorce settlements are fairly easy to acquire and are less expensive than contested divorce settlements. In all contested divorces, prior to a judge hearing the case, mediation, a form of dispute resolution, is required by Florida divorce law. Mediation is often the best chance for the parties to have a direct say in how their case is resolved. A Certified Mediator facilitates the discussion between the two parties and their attorneys, to resolve issues and find common ground. In the event the parties cannot resolve all of their issues, the cases are then sent to the court, where a judge will decide the ultimate outcome.
